General information
We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
Delivery Information
This website is only for delivery of products to customers in mainland UK and Northern Ireland address. Please allow 5 working days for delivery after the payment has been processed. We make every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. Hilka shall be under no liability for any delay or failure to deliver the products within estimated timescales.
Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.
Returns & Refunds
Unwanted goods to items you have ordered in error.
You should inform us of your decision within 14 days from the date on which you received the item(s).For quality reasons we have to inspect the items you have returned, not least to ensure they have been restored to us in full and good order. Upon completing a satisfactory validation of the goods returned, we will refund you any money paid for the product. We will normally process your refund 10 working days of our receiving your return. Refunds are made using the same form of payment as used to make the original transaction.
Faulty goods:
If there is a fault with your product within 12 months of delivery we will normally offer a replacement. Please ensure that your product(s) are accompanied by the original delivery note or invoice. To qualify for a refund or replacement.
This guarantee does not cover faults caused by accident, neglect, misuse or normal wear and tear.
Spares that have to be fitted internally are also guaranteed for three months, provided they have been fitted by suitable qualified and competent person.
Items Received Damaged:
Please report the damage within 3 working days via this website or by calling our helpline.
Payment methods
All prices are in £ sterling. Inclusive of VAT. Postage and packing is free within the UK and Northern Ireland. You may pay by any major credit or debit cards. We accept:
Visa and MasterCard credit cards and Visa Delta, Visa Electron, Maestro and Solo Debit cards.
Product Prices
Prices, offers and products are subject to availability and may change before (but not after) we accept your order. We try to ensure that all information on this site is accurate. However, an error may occur. If we discover an error in the price or description of a product you have ordered, we will tell you and ask if you wish to continue with your order or cancel it.
HILKA TOOLS UK WHOLESALE CUSTOMERS TERMS OF BUSINESS
Order Quantities
Order quantities are shown throughout the catalogue and price list the first figure is the main shipping carton with the lower figures being the inner or practical ordering quantities we recommend ordering in these quantities to ensure the goods are well packed and protected in shipping. We will however accept orders for single items when part of a main order to give customers a chance to ensure the item is what is required. Stock not available at time of processing will be dealt with as per customers instructions if held on backorder they will normally be delivered with the customer’s next order.
Carriage
Paid on all orders in excess of £150 net value on the mainland £500 net value Northern Ireland etc. A charge for orders under that value will be made of £6.00 Orders under carriage paid will automatically be treated as ex stock or cancel. No balances will be supplied without prior arrangement.
Carriage Overnight
This can be arranged providing the order is received in the Sales Office by 12.00 p.m. and is subject to the following charges:
- Under Carriage Paid: £12.00
- Over Carriage Paid: £2.00 per carton or £20.00 per pallet.
For Northern Ireland and Northern Scotland prices upon application.
Payment Terms
Net 28 days.
Prices
Ruling as at date of despatch. This price list cancels all previous lists. All prices are exclusive of VAT.
Claims
Shortages must be advised in writing to us on day of receipt. Qualified signatures must be given to carriers. Non delivery to be advised in writing to this company within 10 days of receipt of invoice. Details given to our representative will not be accepted.
Return of Goods
Goods will not be accepted for return without prior authorisation by the Area Sales Representative or the Sales Office Supervisor. Items to be returned must be in a saleable condition, i.e. packed in inner and outer cartons as received, with full documentation enclosed. Returns, which do not comply with this requirement, will not be accepted for credit. The Company does not deal on a Sale or Return basis.
Faulty Items
In the event of faulty items, these should be returned to our address with full documentation, or held for inspection by your area representative upon receipt a credit note will be issued unless a replacement is requested.
Exchange Surcharges
Prices are based on Exchange Rates at time of going to press and should there be any alteration in these rates we reserve the right to apply an Exchange Surcharge.
Amendments
The Company policy is to continually increase the content and quality of our tools and we reserve the right to alter the specifications or delete a product without prior notice.
Retention of Title
Notwithstanding delivery and the passing of risk, the property in and title to the any goods shall remain with Hilka Tools (UK) Ltd until Hilka Tools (UK) Ltd has received payment of the full price of:
(a) all goods, products and or services subject of the contract
(b) all other goods, products and or supplied by Hilka Tools (UK) Ltd to the buyer under any contract whatsoever
Payment of the full price shall include, without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between Hilka Tools (UK) Ltd and the buyer.
Force Majeure
Every effort will be made to carry out the contract but its due performance is subject to cancellation by the Company or to such variations as he may find necessary as a result of inability to secure labour, materials or supplies or as a result of an Act of God, War, Strike, Lockout or any other labour dispute, fire, Flood, Drought. Legislation or any cause (whether of the foregoing class or not) beyond the Company’s control.
Overdue Accounts and Recovery
The Company may apply interest to all balances remaining outstanding following expiry of the credit terms stated above. Such interest to be calculated on a daily basis at a rate of 3% above the Bank of England Minimum Lending Rate. In the event of there being a necessity for the institution of legal proceedings for recovery of overdue or outstanding monies then the full legal costs of recovery will be aggregated with the debt for which the proceedings will be instituted.
